The technology itself isnt illegal, but as with everything you download, copyright laws apply. many files distrbuted on these networks are protected.
many anti-piracy angencies has put up fake eMule servers to stop the illegal peer-to-peer sharing, so make sure what you download. you could also check out peer guardian http://phoenixlabs.org/pg2/

As said earlier in this thread, it is based off of what is downloaded. Do you download music? Videos? TV shows? Those are illegal to download unless A. They are not copyrighted B. They are from independant groups who state that the music is not copyrighted OR it is public.
