Hi everybody, I have a serious problem
Here's the situation. Let's assume that Sean Murphy is a popular cultural name (not a superstar;famous only in a certain cultural field, e.g. classical music).
Now let's assume that I'm a close relative to Mr. Murphy (son, or grandson) and I have a company operating in his field and I have trade marked his name.
One day one of my competitors register seanmurphy.com (or .net or .org) and forwards it to his site, meaning uses my name for his benefits.
Do I have any legal rights to sue him or/and force him to give this domain name to me?
The name is frictional, but the situation is not, so, before I ring my solicitor, I would love to listen to your advice
