Hi everybody, I have a serious problem

Here's the situation. Let's assume that Sean Murphy is a popular cultural name (not a superstar;famous only in a certain cultural field, e.g. classical music).
Now let's assume that I'm a close relative to Mr. Murphy (son, or grandson) and I have a company operating in his field and I have trade marked his name.

One day one of my competitors register seanmurphy.com (or .net or .org) and forwards it to his site, meaning uses my name for his benefits.

Do I have any legal rights to sue him or/and force him to give this domain name to me?

The name is frictional, but the situation is not, so, before I ring my solicitor, I would love to listen to your advice

IANAL. But based on what I know and what you've given so far, then I'd say
you have a chance.

However, do seek your solicitor for advice to review any and all facts. If s/he
isn't "competent" enough to handle it, find someone who is.

As soon as this annoying situation is resolved, I will post here the outcome so that somebody else would know what to do

Better get a good solicitor. See the cyber laws first, but. Use wikipdia

first talk in peace with him and ask for some compensation, of course $$$.
making more friends and less enemies, seem better for a businessmen

if not ok, bring the case to court is not a bad idea.
remember any case , you need to pay some $$4 to lawyers.

just for your reference only and final discison is up to you only

trade marks for a buisness eg EA - Action, Fantasy, Sports, and Strategy Videogames are valid so if someone made a site like www.eabuisness.com they could get done but if it was like www.eazy.com they MIGHT NOT get done, it depends on how much ea pays there lawyers :P
